Diligent Search Statement - Change In Processing

The Oregon Division of Financial Regulation has approved a change in the way the Surplus Line Association of Oregon processes the Diligent Search Statement Form 100.  Effective on January 1, 2017, the SLAOR will no longer be required to receive an electronically uploaded DSS from the filer.  Instead, the Division will allow the SLAOR to review an acknowledgement from the filer that they indeed have received a properly completed and signed DSS from the producer and that the filer will retain the DSS along with the other records of each surplus lines insurance contract on site at their places of business for no less than five (5) years following contract termination.

There is no change in the OR Insurance Code and Surplus Lines Law (ORS 735.400-495).  Sections 735.410 Conditions for procuring insurance through nonadmitted insurer, 735.425 Filing by licensee after placement of surplus lines  insurance, and 735.460 Records of licensee all still apply and should be understood and complied with by all licensees.
